Terms

1. Who we are
FitnessPeak is operated by H5 Innovations AS. Contact: hello@fitnesspeak.app. Using the service means accepting these terms.
2. What the service is
FitnessPeak is a hosted MCP server that gives AI assistants read-only access to fitness data from accounts you connect. You need your own WHOOP account and your own MCP client; we provide neither.
3. Your account
- You must be 16 or older.
- One account per person. Sharing a subscription across people isn't permitted.
- You're responsible for keeping your API keys private. Revoke a key immediately if it leaks — the button is in your dashboard.
- Give us a working email address; we use it for service notices you'll want.
4. Payment
- The subscription costs $39 per year, billed annually in USD.
- New accounts get a 14-day free trial. A valid card is required to start it. We take a small verification charge and refund it immediately.
- If you don't cancel before the trial ends, the annual subscription starts and your card is charged.
- Subscriptions renew automatically each year until cancelled.
- Cancel any time from your dashboard. You keep access until the end of the period you've paid for. We don't pro-rate partial years.
- If a renewal payment fails, we keep your access on for a grace period while the payment is retried, then suspend it.
5. Refunds
Email support@fitnesspeak.app within 30 days of a charge and we'll refund it, no argument. The 14-day trial exists so this should rarely be needed. EU consumers keep their statutory withdrawal rights regardless of this paragraph.
6. Acceptable use
Don't:
- Access data belonging to anyone who hasn't consented.
- Resell, sublicense or rebrand the service.
- Attempt to break, overload or circumvent rate limits or authentication.
- Use the service unlawfully, or in a way that breaches WHOOP's own terms.
We may suspend an account that does these things. Where it's reasonable, we'll tell you first.
7. Third-party services
FitnessPeak depends on WHOOP's developer API and reads your WHOOP data only with your explicit consent, given on WHOOP's own authorisation screen and revocable at any time from either side. Access is read-only: we request no write scopes, so FitnessPeak cannot modify anything in your WHOOP account. We are not affiliated with, endorsed by, or sponsored by WHOOP, Inc. If WHOOP changes or withdraws API access, our service may change or stop — and if that happens permanently, we'll refund the unused portion of your subscription.

Your AI client is also a third party. Data returned by our tools goes to that provider under their terms.
8. Not medical advice
FitnessPeak is not a medical device and does not provide medical advice. It returns fitness metrics. Any interpretation comes from your AI assistant, and AI assistants make mistakes. Don't use it to diagnose, treat or make decisions about a medical condition. Talk to a qualified clinician.
9. Availability
We aim to keep the service up but don't offer a formal uptime guarantee at this price. We'll give reasonable notice of planned maintenance where we can.
10. Liability
To the extent the law allows, our total liability for any claim is limited to what you paid us in the twelve months before it arose. We're not liable for indirect or consequential loss, or for decisions made on the basis of data or AI-generated interpretation. Nothing here limits liability for death, personal injury caused by negligence, or fraud.
11. Ending it
You can cancel or delete your account at any time. We may terminate for a material breach of these terms, or with 30 days' notice and a pro-rata refund if we discontinue the service.
12. Changes
We may update these terms. Material changes get emailed to active subscribers at least 30 days ahead. Continuing to use the service after that means accepting them.
13. Law
These terms are governed by Norwegian law, with the courts of Norway having jurisdiction. If you're a consumer in the EU/EEA, you keep the protections of your home country's mandatory consumer law.
